Home » Electronic Commercial Message Consent Text

According to the Law on Regulation of Electronic Commerce No.6563 and related legislation, commercial electronic messages refer to data, voice, and image content sent via electronic media, such as telephone, call centers, fax, automatic dialing machines, smart voice recording systems, electronic mail, short message service, for commercial purposes.

Commercial electronic messages can only be sent to recipients with their prior consent. Commercial electronic messages cannot be sent to recipients who do not have consent on the Electronic Commercial Message Management System (“İYS”). This consent can be obtained in writing or through any electronic communication tools or through the İYS (if the system is available). In the consents obtained through the İYS, positive intent declaration and electronic communication address are included. Recipients can refuse to receive commercial electronic messages at any time without stating any reason. The recipient’s refusal notification invalidates the consent for the communication channel to which the notification is made. Recipients can also exercise their refusal right through the İYS (if the system is available).

If the recipient provides their contact information to be contacted, separate consent is not required for commercial electronic messages regarding changes, usage, and maintenance related to the provided goods or services.

It is not mandatory to obtain prior consent for sending commercial electronic messages to merchants or craftsmen. However, if merchants and craftsmen exercise the right of refusal specified in the relevant legislation, commercial electronic messages cannot be sent without their consent. In this context, the electronic communication addresses of recipients who are merchants or craftsmen are recorded in the İYS by the service provider, and it is checked through the İYS whether the recipients have exercised their refusal right or not.
